Fine For Dangerous Driving
Road accidents in India are rising rapidly. The driver’s penchant for speed driving is a danger that is threatening the lives of many, including the driver.
The traffic rules violations like signal jumping, speeding and drunken driving in metropolitan cities are rampant today.
Dangerous Driving
Dangerous driving could involve various acts and / or conditions. The most major causes of dangerous driving are listed below:
- Driving Under the Influence of Drugs or Alcohol: Driving a vehicle in an inebriated state of mind is totally banned under the law.
- Driving in A Tired State of Mind: Driving a vehicle in a tired state of mind is highly risky and can be a potential cause for a road accident.
- Speed Driving: Driving a vehicle above the permissible speed limit is illegal.
- Distracted Driving: Distracted driving includes talking on the phone, texting messages, eating or drinking by the driver while driving.
- Reckless Driving: Reckless driving includes swerving, weaving in and out of traffic, accelerating or braking suddenly by the driver of a vehicle while driving.
Driving Without License
Driving without license is not permissible under the Motor Vehicles Act. The amended Motor Vehicles Act that becomes effective from September 2019 lists this as a punishable offence. The driver without a valid license will be penalised heavily for violation of this vital traffic rule.
A Third Party Insurance Is Mandatory for All Vehicles
A third party insurance policy is mandatory for all vehicles before hitting the Indian roads. Any victim of a road accident can claim compensation from the owner of the involved vehicle. In such an eventuality, the third party insurance policy protects the owner from such an unforeseen future financial liability. There is also a without insurance fine imposable under the Act.
Dangerous Driving Punishable Under Law
There is a fine for dangerous driving listed in the statutes. There are various types of fines for dangerous driving such as:
- unsafe driving fine
- drunk driving fine
- fine for driving without license
Erstwhile Low Fine for Dangerous Driving
Earlier the fine for dangerous driving was only Rs. 1000. Thus, the drivers had a field day by paying the measly fine and continued to break the laws and indulge in dangerous driving
New Traffic Rules Includes Dangerous Driving
The new traffic rules have included dangerous driving as an offence punishable under law. The Act has prescribed a penalty for dangerous travel in India. Currently, unsafe driving fine, drunk driving fine, etc. are clubbed together under the fine for dangerous driving category.
The Fines Imposable Today for Dangerous Driving
The fine amounts for dangerous driving have been amended post September 2019. The revised penalties are as given below:
OFFENCE
FINE
First time offence
Imprisonment from 6 months to 1 year and / or Fine of Rs. 1000 to Rs. 5000
Second time offence
Imprisonment up to 2 years and / or Fine up to Rs. 10000
Fines to Act as Deterrent
This imposition of high fines should ideally act as a deterrent for those who indulge in dangerous driving. The violators will definitely feel the pinch in their purse for the penalty for dangerous travel. There is also a serious risk of being put behind bars.
Road Ahead
Fine for dangerous driving does help in curbing road accidents but the main factor remains is the attitude which can only change through creating awareness for road safety.
