Bharti AXA INSURANCE GLOSSARY Fraud A fraud is an intentional act of deception. It is designed to gain an unfair advantage, or deprive someone of their legal right. It could also be designed to make someone give away something valuable. A fraud can involve a concealment, omission or perversion of truth. Any party who has been defrauded can file a lawsuit for damages against the fraudulent party. In case of civil fraud, the punitive measures are monetary in nature. In case of criminal fraud, the punitive measure is imprisonment. More than one person maybe involved in a scheme to commit fraud, and each of them maybe held liable for the damages awarded. A constructive fraud can be proven by showing that a party breached their legal duty without showing an intent to fraud. An example of this is when someone fails to declare a known mistake they are dutybound to reveal. An extrinsic fraud is when a party is deceived in a manner that stops them from exercising a right. For example, misleading a party in a lawsuit to avoid fair trial. In rare cases, the courts may award exemplary damages in case of civil fraud. This is done not just to compensate the party that was defrauded, but to punish the fraudulent party and set an example to the public at large.
