What Are The Fines And Penalties If You Ride Without A Two-Wheeler Insurance

In India, two-wheeler insurance was first introduced under the Motor Vehicles Act, 1988, while all motor insurance products in the country are regulated by the IRDAI (Insurance Regulatory Development Authority of India)

Acting on a recent directive passed by the Supreme Court of India, IRDAI has made it mandatory for all two-wheeler motor vehicles in the country to be covered under a 5-year, third-party liability cover, right at the time of purchase of the vehicle.

In case, any vehicles running on Indian roads that do not have a valid insurance policy are liable to heavy monetary fines and penalties.

Essential Guidelines for Two-Wheeler Riders in India

In India, the ‘Rules of the Road Regulation’ were introduced in July 1989. These rules and regulations provide the legal framework, which always aims to promote safe driving conditions to drivers in the country and ensure precise traffic movement.

Any violations, transgressions or negligence in abiding by any of these rules are considered a serious offence under the city-specific traffic police rules and the Indian Motor Vehicle Act 1988.

Key aspects of the Indian Motor Vehicle Act 1988, concerning two-wheelers are:

  • The individual driving the vehicle (any type) must be 18 years of age or above
  • The rider must carry a valid Driver’s Licence
  • The vehicle should be registered under the Indian Motor Vehicle Act 1988, and the rider must carry a certificate of registration to that effect
  • The individual must have valid third-party bike insurance
  • Both the rider and pillion must wear helmets belts when riding the two-wheeler
  • The vehicle should be tested for pollution against the relevant emission standards, and the rider must carry the proof of pollution check

At any instance, while the two-wheeler is being driven across the country, a traffic constable can stop the vehicle and ask to produce all relevant documents of the two-wheeler. Failure to present any one of the documents mentioned above may incur applicable fines or penalties.

Riding Without Valid Two-Wheeler Insurance - Fines and Penalties

Driving without valid two-wheeler insurance may carry the following fines and penalties:

Heavy Fines

Driving a two-wheeler motor without third-party insurance cover is prohibited under the Motor Vehicle Act 1988. In case, you are caught by traffic police without insurance; the authorities may impose a monetary fine up to Rs 1000 or imprisonment up to 3 months or both.

Loss of No Claim Bonus

In case your bike insurance cover has lapsed, you may lose any accumulated policy benefits such as no claim bonus (or NCB). If your bike remains uninsured for more than 90 days, you will lose the accrued benefits. Moreover, you shall lose out on the opportunity of transferring the NCB benefit to the new two-wheeler, should you buy one.

Legal Liabilities

A comprehensive bike insurance policy will covers you from any contingencies, including natural and human-made calamities.

On the other hand, if your vehicle is not insured and you meet an accident, you would have to bear the complete cost of repair/damages. Moreover, if you are caught in a road accident resulting in the death of another individual, you may face two legal cases:

  • A criminal case (for negligent driving)
  • A compensation claim filed by the deceased’s family

The compensation amount provided to the deceased’s next of kin will be borne by you.
